{"id":3081,"date":"2021-06-04T11:29:14","date_gmt":"2021-06-04T03:29:14","guid":{"rendered":"https:\/\/yhalaw.com.my\/?p=3081"},"modified":"2024-09-09T09:11:39","modified_gmt":"2024-09-09T01:11:39","slug":"tort-law-defamation-politicians-parliamentary-privileges-immunity-from-prosecution","status":"publish","type":"post","link":"https:\/\/yhalaw.com.my\/my\/tort-law-defamation-politicians-parliamentary-privileges-immunity-from-prosecution\/","title":{"rendered":"TORT LAW \u2013 DEFAMATION \u2013 POLITICIANS \u2013 PARLIAMENTARY PRIVILEGES \u2013 IMMUNITY FROM PROSECUTION"},"content":{"rendered":"<p><strong><em>Fitnah<\/em><\/strong><\/p>\n<ul>\n<li>Publication of a statement that lowers the reputation of another person.<\/li>\n<\/ul>\n<p><strong><em>Types of Defamation<\/em><\/strong><\/p>\n<ul>\n<li>Libel \u2013 Defamatory statement in a permanent form (e.g. articles, Facebook posts, WhatsApp messages).<\/li>\n<li>Slander \u2013 Defamatory statement in a temporary form (e.g. spoken words).<\/li>\n<\/ul>\n<p><strong><em>&nbsp;<\/em><\/strong><strong><em>Can a politician be sued for defamation in the Parliament?<br \/>\n<\/em><\/strong><strong>No. <\/strong><\/p>\n<ul>\n<li>A defamation suit is not possible against a politician for words spoken in the House of Parliament.<\/li>\n<\/ul>\n<p><strong><em>Why can\u2019t a politician be sued?<\/em><\/strong><\/p>\n<ul>\n<li>To enable Parliament to perform their functions effectively and without interference from anyone outside of Parliament, the Constitution confers certain rights and legal immunities under \u201cParliamentary Privileges\u201d Members of Parliament (\u201c<strong>MP<\/strong>\u201d).<\/li>\n<li>In other words, it is to safeguard the freedom, the authority and the dignity of Parliament.<\/li>\n<\/ul>\n<p><strong><em>Is this governed by any Malaysia law?<br \/>\n<\/em><\/strong><strong>Yes.<\/strong><\/p>\n<ul>\n<li>Article 63(2) and 63(3) of the Federal Constitution &#8211; No person shall be liable to any proceedings in court for anything said or published by them in either Houses of Parliament.<\/li>\n<li>Section 7 of the Houses of Parliament (Privileges and Powers) Act 1952 &#8211; Immunity of members from civil or criminal proceedings.<\/li>\n<li>Generally speaking, MP enjoys complete freedom of expression in the House and in the committees of the House.<\/li>\n<\/ul>\n<p><strong><em>&nbsp;<\/em><\/strong><strong><em>What are the actions that can actually be taken against the politician?<\/em><\/strong><\/p>\n<ul>\n<li>Each House has power to discipline its own members.<\/li>\n<li>Each House can penalize its members for breaches of the privileges or contempt of that House.<\/li>\n<li>If a politician is accused of abusing his freedom of speech or of committing contempt of the House, he may be investigated, tried and either convicted or acquitted by the House itself.<\/li>\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>Defamation &#8211;
