{"id":4847,"date":"2023-05-23T16:00:24","date_gmt":"2023-05-23T08:00:24","guid":{"rendered":"https:\/\/yhalaw.com.my\/?p=4847"},"modified":"2024-09-09T09:11:32","modified_gmt":"2024-09-09T01:11:32","slug":"criminal-law-malaysian-anti-corruption-commission-power-of-arrest-and-extension-of-remand","status":"publish","type":"post","link":"https:\/\/yhalaw.com.my\/my\/criminal-law-malaysian-anti-corruption-commission-power-of-arrest-and-extension-of-remand\/","title":{"rendered":"CRIMINAL LAW\u2013 MALAYSIAN ANTI-CORRUPTION COMMISSION \u2013 POWER OF ARREST AND EXTENSION OF REMAND"},"content":{"rendered":"<p><strong>The recent arrest of company directors and continued remand using Section 117 of the Criminal Procedure Code has sparked widespread unrest about the possible misuse of Malaysian Anti-Corruption Commission\u2019s (\u201cMACC\u201d) power.<\/strong><\/p>\n\n\n\n<p><strong>What are the powers of MACC on detention of suspects?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em><u>Section 49(1) of the Malaysian Anti-Corruption Commission Act 2009<\/u><\/em><\/strong> (\u201c<strong>MACC Act 2009<\/strong>\u201d) says all offences under the MACC Act are \u201c<em>seizable offence<\/em>\u201d(s).<\/li>\n\n\n\n<li>\u201c<em>Seizable offence<\/em>\u201d means offence which MACC officer may arrest without a warrant.<\/li>\n<\/ul>\n\n\n\n<p><strong>What happened after a person is detained by MACC?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A person can be detained by the MACC for offences investigated under the MACC Act.<\/li>\n\n\n\n<li>However, he cannot be detained for more than 24 hours without being produced before a magistrate. This rule is set out in <strong><em><u>Article 5 clause 4 of the Federal Constitution<\/u><\/em><\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>What happened if he needs to be detained for more than 24 hours?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em><u>Article 5 clause 4 of the Federal Constitution<\/u><\/em><\/strong> says a person cannot be detained for more than 24 hours.<\/li>\n\n\n\n<li>MACC is not allowed to utilize <strong><em><u>Section 117 of the Criminal Procedure Code<\/u><\/em><\/strong> (\u201c<strong>CPC<\/strong>\u201d) to go before a Magistrate to extend a remand pursuant to the principle of <em>generalibus specialia derogant<\/em>.<\/li>\n\n\n\n<li>Hence, when a person is detained and further investigation is required, MACC has to first release the person from custody on a bail or bond with or without sureties.<\/li>\n<\/ul>\n\n\n\n<p><strong>What happened if a person is unable to pay the bail or bond?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The difficulty arises when a person cannot afford to pay the bail or bond requested by MACC.<\/li>\n\n\n\n<li>He still cannot be arrested for more than 24 hours. In such situation, a judicial review may be filed to determine what is the \u201c<em>reasonable sum of money<\/em>\u201d as bail and bond.<\/li>\n<\/ul>\n\n\n\n<p><strong>Under what circumstance can a person be produced before the Magistrate for extension of remand?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>This is set out in <strong><em><u>Section 49(2), (3) and (4) of the MACC Act 2009<\/u><\/em><\/strong>.<\/li>\n\n\n\n<li>A person can only be produced before a Magistrate when the condition of the bail or bond is broken or likely to be broken and he\/she is re-arrested and not released within 24 hours.<\/li>\n\n\n\n<li>Keeping in mind, this only happens when there is a re-arrest.<\/li>\n\n\n\n<li>MACC is not allowed to produce a person before the Magistrate for extension of remand without going through the processes in Sub-Sections 49(2), (3) and (4). The Magistrate would not have power to grant remand under the circumstances.<\/li>\n<\/ul>\n\n\n\n<p><strong>What happened if MACC detained a person for more than 24 hours on the first arrest or re-arrest without production before a Magistrate?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The arrest would be unlawful.
