{"id":2594,"date":"2020-09-25T10:51:23","date_gmt":"2020-09-25T02:51:23","guid":{"rendered":"https:\/\/yhalaw.com.my\/?p=2594"},"modified":"2024-09-09T09:11:41","modified_gmt":"2024-09-09T01:11:41","slug":"procedures-of-perfection-of-transfer-registration-of-charge","status":"publish","type":"post","link":"https:\/\/yhalaw.com.my\/zh\/procedures-of-perfection-of-transfer-registration-of-charge\/","title":{"rendered":"PROCEDURES OF PERFECTION OF TRANSFER &#038; REGISTRATION OF CHARGE"},"content":{"rendered":"<p><span style=\"text-decoration: underline;\">PERFECTION OF TRANSFER<\/span><\/p>\n<p>Perfection of Transfer (\u201cPOT\u201d) is necessary to transfer the ownership to the Purchaser(s) when the strata title \/ individual title is issued by the Developer.<\/p>\n<p><span style=\"text-decoration: underline;\">Procedures<\/span><\/p>\n<ul>\n<li>Step 1: The Purchaser(s) shall appoint his\/her solicitors.<\/li>\n<li>Step 2: The Purchaser(s) shall issue Letter of Authorisation to the solicitors to handle the POT.<\/li>\n<li>Step 3: The solicitors will send the Letter of Authorisation to the Developer and liaise with the Developer for the necessary documents (i.e: a copy of title and Developer\u2019s company documents)<\/li>\n<li>Step 4: The solicitors will prepare Memorandum of Transfer (Form 14A). The Form 14A shall be executed by both the Developer and the Purchaser(s).<\/li>\n<li>Step 5: Upon execution, the Developer shall deliver the original title to the solicitors for the purpose of transferring the ownerships to the Purchaser(s).<\/li>\n<li>Step 6: The solicitors shall adjudicate the Form 14A and the Purchaser(s) shall pay stamp duty of the transfer of the Property subject to the purchase price of the Property.<\/li>\n<li>Step 7: The solicitors shall present the Form 14A at the Land Office in order to transfer the ownership from the Developer to the Purchaser(s).<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">REGISTRATION OF CHARGE<\/span><\/p>\n<p>If the Purchaser(s) obtains a loan to purchase the Property, the Purchaser(s) shall charge the Property to the bank by way of Registration of Charge (\u201cROC\u201d).<\/p>\n<p><span style=\"text-decoration: underline;\">Procedures<\/span><\/p>\n<ul>\n<li>Step 1: The Solicitors shall prepare charge documents (i.e Charge Annexure and Form 16A).<\/li>\n<li>Step 2: The charge documents shall be executed by the Purchaser(s) and the bank officer.<\/li>\n<li>Step 3: Upon execution of the charge documents, the solicitors shall endorse the charge documents on the LHDN website.<\/li>\n<li>Step 4: The Purchaser(s) shall pay stamp duty of the charge documents (i.e: RM10.00 per copy).<\/li>\n<li>Step 5: The solicitors shall present the charge documents at the Land Office in order to register the charge in favour of the Bank.<\/li>\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>&#8220;What is the procedure to get my strata title?&#8221;<\/p>","protected":false},"author":1,"featured_media":2595,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1575,1567,1579],"tags":[1595],"class_list":["post-2594","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-conveyancing","category-property-law","category-real-estate","tag-procedures-perfection-transfer-charge"],"_links":{"self":[{"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/posts\/2594"}],"collection":[{"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/comments?post=2594"}],"version-history":[{"count":3,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/posts\/2594\/revisions"}],"predecessor-version":[{"id":2952,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/posts\/2594\/revisions\/2952"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/media\/2595"}],"wp:attachment":[{"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/media?parent=2594"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/categories?post=2594"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/yhalaw.com.my\/zh\/wp-json\/wp\/v2\/tags?post=2594"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
