Can I do short term rental via booking platforms such as Airbnb, klsuites, booking.com, agoda.com?<\/b><\/p>\n<p class=\"v1MsoListParagraphCxSpMiddle\">A:<\/p>\n<ul>\n<li class=\"v1MsoListParagraphCxSpMiddle\">Short-term rental is permissible only if the house rules of your condominium do not prohibit it.<\/li>\n<li class=\"v1MsoListParagraphCxSpMiddle\">In <i>Innab Salil &amp; Ors v Verve Suites Mont\u2019 Kiara Management Corp,\u00a0<\/i>it was decided that management corporations and joint management bodies (JMBs) could ban short-term rentals through their own house rules.<\/li>\n<\/ul>\n<p class=\"v1MsoListParagraphCxSpMiddle\"><b>Q: Isn\u2019t that prohibition of short-term rentals a violation of my right as owner of my unit<\/b>?<\/p>\n<p class=\"v1MsoListParagraphCxSpMiddle\">A:<\/p>\n<ul>\n<li class=\"v1MsoListParagraphCxSpMiddle\">The Federal Court\u2019s decision in <i>Innab Salil<\/i>\u00a0reinforces the entitlement of management corporations and bodies under the Strata Management Act 2013 (\u201c<b>SMA 2013<\/b>\u201d) to create by-laws restricting the engagement in short-term rentals of the owner\u2019s units.<\/li>\n<li class=\"v1MsoListParagraphCxSpMiddle\">Management bodies can now create by-laws with the intention of curbing short-term rentals in the buildings under its management.<\/li>\n<\/ul>\n<p class=\"v1MsoListParagraphCxSpMiddle\"><b>Q: If the State Authority permits the use of the land of which the building is built for commercial purposes, can the House Rules prohibit the owners from doing short-term rental. Are those House Rules valid?<\/b><\/p>\n<p class=\"v1MsoListParagraphCxSpMiddle\">A:<\/p>\n<ul>\n<li class=\"v1MsoListParagraphCxSpMiddle\">Even if the building is built on a land slated for commercial use, the Management Corporation or bodies established under the SMA 2013 may via AGM pass by-laws prohibiting use of the unit for short-term rental purpose.<\/li>\n<\/ul>\n<p class=\"v1MsoListParagraphCxSpMiddle\"><b>Q: What if I ignore the house rules of the condominium\u2019s management and continue to rent out my unit to short-term renters?<\/b><\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium wp-image-2650 alignright\" src=\"https:\/\/yhalaw.com.my\/wp-content\/uploads\/2020\/11\/image001-1-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/yhalaw.com.my\/wp-content\/uploads\/2020\/11\/image001-1-300x200.jpg 300w, https:\/\/yhalaw.com.my\/wp-content\/uploads\/2020\/11\/image001-1-272x182.jpg 272w, https:\/\/yhalaw.com.my\/wp-content\/uploads\/2020\/11\/image001-1.jpg 385w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p class=\"v1MsoListParagraphCxSpMiddle\">A: The Management Corporations, JMB or developer may obtain an injunction restraining you from so doing.
