{"id":2932,"date":"2021-04-14T12:05:28","date_gmt":"2021-04-14T04:05:28","guid":{"rendered":"https:\/\/yhalaw.com.my\/?p=2932"},"modified":"2024-09-09T09:11:40","modified_gmt":"2024-09-09T01:11:40","slug":"defamation","status":"publish","type":"post","link":"https:\/\/yhalaw.com.my\/zh\/defamation\/","title":{"rendered":"WHATSAPP MESSAGES \u2013 ADMISSIBILITY AS EVIDENCE IN THE COURT OF LAW"},"content":{"rendered":"<p><strong><em>Is record of WhatsApp conversations admissible in court?<br \/>\n<\/em><\/strong><strong>Yes.<\/strong><\/p>\n<ul>\n<li>WhatsApp messages are direct evidence.<\/li>\n<li>As long as the WhatsApp messages are relevant, they are admissible to prove the existence of facts.<\/li>\n<li>WhatsApp messages are relevant to support the existence of any oral conversation or evidence between the individuals.<\/li>\n<\/ul>\n<p><strong><em>Can I use my WhatsApp messages with third party as evidence when the third party could no longer be located and cannot be called as witness?<br \/>\n<\/em><\/strong><strong>Yes.<\/strong><\/p>\n<ul>\n<li>Your WhatsApp messages with the third party is admissible under section 73A(2) Evidence Act 1950 (\u201c<strong>EA 1950<\/strong>\u201d) because the third party cannot be located without undue delay or expense.<\/li>\n<li>However, you have to show that the third party is impossible to be found. The court has the discretion to admit the evidence according to the individual facts of the case.<\/li>\n<li>We are of the view that WhatsApp conversation in its original form is unlikely to be tempered and is reliable.<\/li>\n<\/ul>\n<p><strong><em>Our views:<\/em><\/strong><\/p>\n<ul>\n<li>You can be sued for anything said in WhatsApp as they are written records of your conversation.<\/li>\n<li>You have to be discreet with posting of messages or pictures in a group chat.
