Commissioner for Oaths Fees (As per the Second Schedule of the Commissioner for Oaths Rules 2018):

  • Original affidavit: RM10.00 per deponent
  • Exhibit referred in original affidavit: RM5.00 per exhibit
  • Duplicate or copy of affidavit: RM5.00 per deponent
  • Exhibit referred in duplicate or copy of affidavit: RM2.00 per exhibit
  • Document, affirmation, acknowledgment, deed, or any other instrument: RM10.00 per document
  • Duplicate or copy of document, affirmation, acknowledgment, deed, or any other instrument: RM5.00 per document

Powers of a Commissioner for Oaths

The powers of Commissioners for Oaths are outlined in Rule 9(1) of the Commissioners for Oaths Rules, 2018, with additional provisions for lawyers under Rule 11. As an advocate and solicitor appointed as a Commissioner for Oaths, we are authorized to:

✔ Receive acknowledgements of married women in cases where required by law.
✔ Receive acknowledgements of recognizances of bail and bail bonds.
✔ Administer oaths for:

  • Justification for bail.
  • Taking affidavits or affirmations.
  • Receiving and taking responses in legal proceedings, including answers, pleas, demurrers, disclaimers, and allegations.
  • The examination of witnesses under interrogatories or in legal proceedings.
  • Swearing executors and administrators.
  • Swearing persons involved in any legal action, matter, or proceeding.
    ✔ Take and receive statutory declarations.
